This week, a federal appeals court will hear oral argument in a case that could determine not only the fate of Georgia’s legislative and congressional maps, but also a key aspect of enforcement of the Voting Rights Act (VRA). In a moment, I’ll share more details about this case, the broader pattern it fits into, and how anti-democracy forces are desperately trying to hold on to power by going after the VRA. But first, I’m asking you to make a donation to help fight for equal representation in Georgia and nationwide. This case traces back to Georgia’s 2021 redistricting cycle. Data from the 2020 Census showed that the state’s Black population had grown by more than 15 percent, while the white population had decreased by over 4 percent. But anti-democracy legislators enacted a congressional map that overrepresented the state’s white population and diluted Black voting power. Our affiliate, the National Redistricting Foundation (NRF), sprang into action to initiate a legal challenge, arguing that Georgia’s congressional and state legislative maps all violated Section 2 of the VRA, which protects against vote dilution. The court agreed. Following the NRF’s win at the U.S. Supreme Court in the 2023 landmark decision Allen v. Milligan, which upheld Section 2, a Georgia federal court ordered the state to draw new maps in November 2023. The state’s new maps failed to provide the additional representation ordered, however, and Georgia further pursued an appeal to the 11th Circuit in an effort to go back to its gerrymanders. Georgia’s arguments throughout the case are part of a larger, concerted effort by anti-democracy forces to use the courts to undermine Section 2 of the VRA. We’re seeing these same types of arguments in states like Louisiana and Alabama to make inadequate “fixes” count or overturn newly enacted fair maps — which all deprive Black voters of their rightful and hard-fought representation. Black Georgians continue to be underrepresented politically to this current day. This is not a question of distant history — this is happening now and still impacting voters.
