Litigation in Brazil can be costly and time consuming. The new Code of Civil Procedure, which came into effect a little over three years ago, was designed to simplify and shorten the duration of judicial proceedings. Yet not much has been changed for those that need to litigate cases in Brazil. Join us for an overview of Brazil’s current judicial system and proceedings in the areas of civil and tax litigation, including a discussion of the practical implications of the new Code of Civil Procedure for companies doing business in Brazil. Our panel of experts will also address frequently asked questions on topics such as attorney-client privilege, disclosure of evidence, publicity of court records, and the effects of injunctions and orders freezing assets.

The development of Brazil’s domestic corporate debt market has long been restricted by high real interest rates, subsidized lending from BNDES, and a variety of legal rules and entrepreneurial customs that favor bank lending over capital markets.

But the barriers to a deep local debt market are eroding.  Inflation and real interest rates are at historic lows. BNDES is reducing its balance sheet and by law must phase out its subsidy program.  Simultaneously, needs are greater than ever for capital intensive infrastructure and for new investment.  These fundamentals are bringing about the expansion of structured and  project finance, and a growing debentures market benefitting from improved regulations and standardization.

Join us for a discussion of today’s market conditions and the outlook for the future.  Secretary João Manoel Pinho de Mello, responsible within Brazil’s Ministry of Finance for the development of  policies, regulations and laws that can expand the local markets, will deliver the keynote address.   His remarks will be followed by a discussion with other panelists who are equally committed to developing markets within Brazil.

This hour and a half long afterschool workshop for kids based on two children’s picture books, Stolen Spirit and Without Words, which introduces a brief overview of Brazil’s early history while encouraging young people to think about their Brazilian heritage through their personal experiences as immigrants, or as the children of immigrants.  This workshop would present some general information about Brazil’s early history through a brief discussion, but it will also be interactive.
Stolen Spirit, which takes place in 1500, focuses on the arrival of the Portuguese from an Indian boy’s point of view.   We can bring objects such as a sample of brazilwood to talk about how Brazil got its name and why the Portuguese were interested in this land. That would be Part I of the workshop.  We would base Part II of the workshop on our book Without Words, which is about a Brazilian immigrant boy who uses his talent for draw to adapt to life in the United States.  We would encourage kids or draw or to write about some personal experience they had with Brazil, and then share that memory with everyone else if they are comfortable.

Strong Data Indicates Strong Economy

Overview: Stronger than expected data in several important areas was good news for the economy but was negative for mortgage rates over the past week. Strength was seen in the labor market, manufacturing, and services. Mortgage rates ended the week higher.

Friday's key monthly Employment Report revealed that the economy added 223,000 jobs in May, above the consensus forecast of 190,000. In addition, upward revisions added 15,000 jobs to the results for prior months. The economy has gained an average of 207,000 jobs per month so far this year. Economists generally estimate that job gains of just 100,000 to 125,000 per month are needed to absorb the growth in the labor force, so readings above 200,000 are viewed as quite strong. The unemployment rate declined from 3.9% to 3.8%, the lowest level since 2000. Average hourly earnings, an indicator of wage growth, were 2.7% higher than a year ago, up from an annual rate of increase of 2.6% last month.

Two other closely watched reports released over the past week also beat expectations and suggested that the economy continues to perform at a high level. The Institute for Supply Management (ISM) Manufacturing Index rose to 58.7, and the ISM Services Index increased to 58.6. Readings above 50.0 indicate an expansion in the sector. Levels above 60.0 have rarely been seen since tracking of this data started in the late 1990s.

Week Ahead
Looking ahead, the next U.S. Federal Reserve meeting will take place on June 13, and investors expect the Fed to raise the federal funds rate by 25 basis points. This will be followed by a European Central Bank (ECB) meeting on June 14. No policy changes are expected at the ECB meeting, but investors will be looking for guidance about the timing of future actions. For major U.S. economic data, the Consumer Price Index (CPI) inflation report will be released on June 12, and the Retail Sales report on June 14.
