State Legislatures ➞ In Ohio, Republicans in the legislature have tried to run out the clock by submitting round after round of manipulated maps as primary elections draw closer. ➞ In Florida, Governor Ron DeSantis vetoed his own party’s maps because they weren’t gerrymandered enough… so lawmakers are likely to start over in a special session. Litigation ➞ The U.S. Supreme Court continues to contradict itself. On the heels of a decision leaving the GOP’s manipulated maps in place in Alabama in part because it was too close to the election to change them, the Court reversed a Wisconsin Supreme Court decision implementing Governor Tony Evers’ maps in their state! ➞ Some Republicans are now promoting a dangerous fringe legal theory that holds only state legislatures have authority over congressional elections. It’s designed to bypass courts standing in the way of map manipulation – but luckily, it hasn’t succeeded (yet). Many fair maps wins during this redistricting cycle relied on the balance of governors and the impartiality of state supreme courts to stop the worst abuses by Republican-controlled state legislatures. Gerrymandered maps were overturned by courts in Ohio and North Carolina and vetoed by governors in Pennsylvania and Wisconsin.

Republicans really don't like the fact that courts have been ruling against their gerrymanders. But instead of just drawing fairer maps, they're trying every trick they can think of to keep the maps manipulated: 1) Running out the clock. The Ohio Supreme Court has now been forced to strike down the GOP's state legislative maps three times. The longer this goes on, the greater the possibility that the 2022 elections will be held on Republicans' gerrymandered maps. 2) Changing the rules to give themselves more power. 3) Promoting dangerous legal theories. They've argued to the U.S. Supreme Court that state legislatures should have sole power over congressional redistricting and elections. 4) Attempting to stack state supreme courts with their hand-picked judges if their legal theories don’t work. And in some states they’re even trying to impeach judges who ruled against them! Florida Governor Ron DeSantis is attempting to bully the legislature into passing the most extreme congressional map possible, and a far-right faction of Missouri Republicans in the legislature have used filibusters in an attempt to secure more power for Republicans. Why does this matter? States like Ohio, Missouri, and Florida all have a shared legacy of voters unifying to enact redistricting reform, and then sadly witnessing politicians systematically attempt to dismantle or dilute that reform. If we don’t hold Republicans accountable for these craven power grabs, we can expect it to continue throughout this redistricting cycle and beyond. Last week, A.G. Holder went as far as to say, “[Last week’s] action by Republicans on the [Ohio] Commission would almost be funny if it were not so consequential and nakedly partisan.
