Senado garante equiparação de direitos entre empregados domésticos e outros trabalhadores

O Senado aprovou, em votação unânime pelo Plenário, a Proposta de Emenda à Constituição que garante mais direitos aos empregados domésticos. Com a promulgação, a agora Emenda Constitucional n° 72 de 2013 garante à classe dos domésticos os mesmos direitos dos demais trabalhadores. Jornada de Trabalho - A jornada de trabalho diária passa a ser de 8 horas. - Caso haja hora-extra, somente se pode trabalhar mais duas horas, até o limite de 10 horas diárias de trabalho. - O valor da hora-extra deve ser pago, no mínimo, com 50% de acréscimo sobre o valor da hora normal de trabalho. - Por semana, o limite é de 44 horas de trabalho. - Pelo trabalho noturno o empregado passa a receber 50% a mais sobre o valor do trabalho diurno. FGTS - Torna-se obrigatória a contribuição para o FGTS. - O empregador deve indenizar o trabalhador em 40% do montante de todos os depósitos realizados durante a vigência do contrato de trabalho, caso faça uma demissão sem justa causa. Salário e benefícios - O salário mínimo passa a ser a base do salário dos empregados domésticos. Não se pode ganhar menos que o mínimo. - É crime reter indevidamente o salário do empregado doméstico. - Direito ao salário-família. - Direito a receber seguro-desemprego caso seja demitido. - Direito ao auxílio-creche. QUAIS DIREITOS PASSAM A VALER IMEDIATAMENTE? - A jornada de trabalho, que passa a ser de 8 horas, com possibilidade de até mais duas horas-extras; e o pagamento da hora-extra. - A contribuição ao FGTS e direito a 40% de indenização em casos de demissão sem justa causa. - Garantia de que o salário não será inferior ao mínimo.  QUE DIREITOS AINDA PRECISAM DA APROVAÇÃO DE LEIS OU DE REGULAMENTAÇÃO PARA PODEREM VALER? - O recebimento de salário-família, do auxílio-creche e do seguro-desemprego. - O trabalho noturno. QUEM SÃO OS EMPREGADOS DOMÉSTICOS? Trabalhador doméstico, de acordo com a Lei nº 5859, de 1972, em seu artigo 1º, é “aquele que presta serviços de natureza contínua e de finalidade não lucrativa à pessoa, ou à família, no âmbito residencial destas”.
